An international forum dedicated to administrative justice and its role in ensuring the rule of law was held in Astana with the participation of Kazakh President Kassym-Jomart Tokayev. The Head of State noted that strengthening trust between citizens and the government is important for stable development. Public harmony can only be achieved through continuous effort. President Tokayev also recalled that Kazakhstan continues to implement the Listening State concept, which is based on open dialogue, attentiveness to citizens’ requests, and prompt responses to public appeals. All representatives of the authorities, including ministers, mayors, governors, and MPs, should take an active part in this work.
«In recent years, Kazakhstan has undertaken fundamental legal and social reforms. As a progressive nation, we must firmly embed the principle of Law and Order as an integral part of our national identity. It is essential to explain in simple terms to citizens, especially young people, the importance of respecting and abiding by the law. Adherence to law and order is a prerequisite for ensuring a high quality of life for citizens. This fundamental principle is clearly enshrined in the new Constitution, adopted through a nationwide referendum,» President Tokayev noted.
The role of administrative justice continues to strengthen, the Head of State noted. Judicial practice in administrative cases has become an indicator of the efficiency of the state apparatus, while also reflecting growing public trust in the justice system. Therefore, enshrining administrative justice in the new Constitution as an independent form of legal proceedings is of fundamental importance, President Tokayev stressed.
«The agenda includes a transition from a reactive model of judicial appeals to a strategic approach to managing litigation risks. The Government has already developed the relevant rules. The next step is to ensure uniformity in administrative acts and procedures at both central and local levels. Issues that have previously been the subject of complaints and appeals should not be subject to repeated litigation. It is essential to ensure consistency and stability in administrative practice,» President Tokayev added.
Additionally, President Tokayev stated that judicial
reforms are taking place in parallel with the country’s economic
transformation. A favorable legal environment, including for resolving
investment disputes, fosters business activity. The Head of State noted that up
to 80% of rulings in investment disputes are currently decided in favor of
investors. He also highlighted Kazakhstan’s special mechanisms to protect
businesses, including the Investment Headquarters under the government, the
Investor Rights Protection Committee of the Prosecutor General’s Office, as
well as the Astana International Financial Centre Court and the International
Arbitration Centre, which operate under the principles of English common law.
According to the President, the country continues to hold a leading regional
position in attracting foreign investment, though efforts in this area must continue.
Today, President Tokayev also presented state awards
to citizens who have made a significant contribution to the development and
improvement of national legislation.
