Kazakhstan’s Constitutional Court has issued an
official interpretation of several provisions of the new Constitution. The clarification concerns the
possibility of re-election or reappointment of persons who held positions during the
period of the 1995 Constitution. It applies to the President, the Chairperson and judges of the Constitutional Court, the
Chairperson of the Supreme Court, and the Prosecutor General. The Court noted that previous terms of service in these positions will not be taken into
account. According to the interpretation, the restrictions established by the
new Constitution take effect only from the date it entered into force.
Therefore, election or appointment after July 1, 2026, will count as the first under
the new Basic Law.
